Hej allesammen. Tænkte på om der var nogle kloge hoveder der er inde i nogle thai love. Jeg har en datter på 1½, sammen med min tidligere kæreste, som er thai og bor i Thailand. Min mor spiste i aftes på den lokale thai restaurant og de var kommet til at snakke om min datter, som jo er halvt thai. Thai indehaveren af restauranten spurgte om hvordan jeg havde fået min datter med til Danmark fordi at dernede (Thailand) er det manden der bestemmer over barnet. Tusindevis af "ikke uden min datter" agtige tanker går selvfølgelig gennem hovedet på en, så nu er jeg lidt nysgerrig på hvordan er lovene omkring blandingsbørn egentlig strukket sammen?! Og nu er det altså ikke fordi jeg frygter min tidligere kæreste vil stikke af med hende...vi var på besøg dernede sidste år, og det var helt fredeligt. Men jeg gad virkelig godt kende "spille reglerne". Nogen der ved noget?! |

Hej! Håber at dette kan hjælpe dig bare lidt. Child Custody in Thailand Child custody disputes between parents can arise in the course of a divorce case, or between unmarried parents. According to Thailand law, both parents of a child have full custodial rights. However, legal issues often surround the finding of paternity. In other words, Thailand law requires that a father be the “legal” parent, as well as the biological parent, to have father’s rights. Father’s Rights Father’s rights are established as a finding of legal paternity. Legal paternity differs from mere biological fatherhood. Many cases have, as a main issue, the establishment of legal paternity. Cases can be filed by a biological father seeking father’s rights, or by a mother, seeking child support and other duties from the biological father. Best Interest Child custody cases are handled in Thailand Family courts. The main consideration used by the courts in determining custody is what is in the best interest of the child. Accordingly the behavior of the parents and child development issues are analyzed closely by the Thai court. The Role of Social Worker Analysis The Observation and Protection Center has been established by the family courts of Thailand to allow for a preliminary social worker evaluation of the parents and the child involved in a child custody dispute. The report of the OPC is forwarded to the Family Court to assist with determination of the child custody issues.
